Nomos Verlag has published a new book entitled "Gesetzgeberische Handlungsspielräume zur Stärkung des aktiven Schallschutzes im Luftverkehrsrecht".
Aviation law currently deals with noise emissions primarily by means of passive noise protection. Active noise protection measures, which start at the source of emissions, are hardly ever addressed and usually remain no more than a consideration when it comes to decision-making. With this in mind, the study analyses how the legal basis for aviation licencing and the definition of flight procedures can be strengthened with regard to active noise protection measures. To this end, it analyses the scope left to legislators by constitutional, EU and international law and also considers the relevant planning levels, i.e. regional planning, land-use planning and sectoral planning.
The book was written by authors including Prof. Dr. Sabine Schlacke [de], Chair of Public Law: Administrative Law and Environmental Law.
